Acceptable Use Policy

This Acceptable Use Policy (“AUP”) is a plain-language summary of what is and is not permitted on the CalvyxDial service. The full and binding rules are in our Terms of Service; this AUP exists to make the headline points easy to reference. If there is any conflict between this AUP and the Terms, the Terms control.
What you may use the Service for
- Outbound voice and SMS campaigns to consenting recipients in compliance with all applicable telemarketing and data-protection laws.
- Inbound voice and SMS handling for legitimate customer service or sales operations.
- Internal business communications, dispatch, support, and similar lawful uses.
- Quality monitoring, agent training, and compliance recording, where local law permits and recipients are appropriately notified.
What you must always do
- Comply with the U.S. Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), the CAN-SPAM Act, GDPR, CCPA, and any other applicable telemarketing or data-protection laws.
- Obtain and document consent for outreach where consent is required.
- Honor Do Not Call requests, federal and state DNC registries, and internal opt-out requests.
- Identify yourself accurately when calling — your business name, your purpose, and a way to opt out.
- Call only during permitted hours in the recipient’s local time zone.
- Provide truthful information to us about your business model, revenue sources, and intended use of the Service.
What is forbidden
We do not allow the Service to be used by, on behalf of, or in support of any business that engages in, derives revenue from, or facilitates:
- Alcoholic beverages of any kind.
- Tobacco, vaping, hookah/shisha, and nicotine delivery products.
- Gambling, betting, casinos, lotteries, sports betting, or monetary fantasy sports.
- Adult entertainment, pornography, escort services, or sexually oriented dating services.
- Recreational cannabis, marijuana, or cannabis-derived recreational products.
- Recreational drugs, controlled substances, or drug paraphernalia.
- Pork or pork-derived products.
- Interest-bearing financial products as the primary revenue mechanism (payday lending, predatory lending, conventional interest-revenue credit cards, traditional interest-based mortgages, conventional speculative-interest insurance).
- High-leverage forex, binary options, cryptocurrency speculation services.
- Multi-level marketing, pyramid schemes.
- Occult services for profit (paid fortune telling, paid astrology, paid psychic readings).
- Defamation services, doxxing, paid harassment campaigns.
- Bribery facilitation, kickback arrangement services.
- Weapons trafficking, unlicensed ammunition sales.
We also forbid: any unlawful conduct; any deceptive, fraudulent, or harassing use; spoofing or falsifying caller ID except as expressly permitted by law; reverse engineering or scraping the Service; and any activity that violates the Terms of Service.
What happens if you violate this policy
Violations are serious. Section 7 of our Terms of Service describes the three-tier consequences in full. In short:
- Immediate — your Account is suspended within 24 hours; you have a 30-day grace to export your data.
- Recovery of actual damages — outstanding balances for service already provided remain due; you fully indemnify us against actual, documented third-party claims, fines, and costs caused by your violation. We do not impose pre-agreed penalties, recovery fees, or liquidated damages — recovery is limited to amounts we can document.
- Long-term — permanent ban; we may publicly disclose the termination if material harm occurred; we may report you to peer providers and law enforcement where lawful.
We never charge interest, late fees, recovery fees, or any other pre-agreed monetary penalty. See Terms §7.2, §8.3, and §8.7.
